General Terms and Conditions for the Ahrens Reitsport GmbH online shop

§ 1 Scope

1. Unless specifically stated otherwise, the following terms and conditions (hereinafter referred to as “GTC”) apply exclusively to all deliveries of goods between Ahrens Reitsport GmbH (hereinafter referred to as “Ahrens”) and a consumer. If no special provisions have been agreed, the general statutory provisions apply. Deviating terms and contractual offers of the customer are excluded.

2. A “consumer” is any natural person who enters into a legal transaction for purposes that predominantly are outside his or her trade, business or profession. A trader, by contrast, is any natural or legal person or partnership with legal personality who or which, when entering into a contract, acts in exercise of his or its trade, business or profession.

3. By placing the order, the customer in turn accepts the GTC for the present contract as binding upon him or her.

§ 2 Conclusion of contract

1. The purchase contract is concluded exclusively with Ahrens Reitsport GmbH, Dorfring 2, represented by the managing director Katrin Lühr, 22889 Tangstedt.

2. Ahrens delivers within the Federal Republic of Germany and to the other Member States of the European Union. Deliveries to countries outside the European Union, for example to Switzerland, are not possible.

3. The customer can select products from the range of goods in the online shop and place them in the cart by clicking the “Add to cart” button. In the cart he or she can change the quantity and add or remove goods. The order can be placed without registration as a guest or via a customer account. By clicking the “Buy now” button, the customer submits a binding offer to purchase the goods in the cart. Before sending the order, the customer can view and change his or her details at any time and correct input errors.

4. The contract is only concluded when Ahrens sends the dispatch confirmation or the ordered goods.

5. If Ahrens is not able, through no fault of its own, to deliver the ordered goods because the supplier of Ahrens does not fulfil its contractual obligations, Ahrens is entitled to rescind the contract with the customer. However, this right of rescission exists only if Ahrens has concluded a congruent covering transaction (binding, timely and sufficient order of the goods) with the relevant supplier and is not otherwise responsible for the non-delivery of the goods. In such a case Ahrens will inform the customer without undue delay that the ordered goods are not available. Any consideration already provided by the customer will be reimbursed without undue delay.

6. If Ahrens is prevented from fulfilling a delivery obligation by the occurrence of unforeseen events affecting Ahrens or its suppliers, which Ahrens could not avert even by exercising reasonable care in the circumstances, for example war, natural disasters and force majeure, the delivery period will be extended appropriately. Ahrens will also inform the customer of this without undue delay. The statutory rights of the customer remain unaffected.

7. Ahrens is entitled to make partial deliveries. Any additional shipping costs incurred as a result will be borne by Ahrens.

§ 3 Consumer’s right of withdrawal

Information on the right of withdrawal

You have the right to withdraw from this contract within fourteen days without giving any reason.

The withdrawal period is fourteen days from the day on which you or a third party named by you, who is not the carrier, have or has taken possession of the last of the goods.

To exercise your right of withdrawal, you must inform us

Ahrens Reitsport GmbH, Managing Director Katrin Lühr,

by means of an unequivocal statement (for example a letter sent by post, fax or email) of your decision to withdraw from this contract. You may use the attached model withdrawal form for this purpose, which is, however, not mandatory.

You can also declare your withdrawal electronically using the “Withdraw from contract” function on our website (www.ahrens-reitsport.de/en/withdraw). If you use this option, we will send you confirmation of receipt of such a withdrawal without undue delay (for example by email).

To meet the withdrawal deadline, it is sufficient that you send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.

Effects of withdrawal

If you withdraw from this contract, we must reimburse to you all payments that we have received from you, including delivery costs (with the exception of the additional costs resulting from your choice of a type of delivery other than the least expensive type of standard delivery offered by us), without undue delay and at the latest within fourteen days from the day on which the communication of your withdrawal from this contract is received by us. For this reimbursement we will use the same means of payment that you used for the original transaction, unless expressly agreed otherwise with you, and in no event will you be charged any fees for this reimbursement. We may withhold reimbursement until we have received the goods back or until you have supplied evidence that you have sent back the goods, whichever is the earlier.

You must send back or hand over the goods to us without undue delay and in any event not later than fourteen days from the day on which you inform us of your withdrawal from this contract. The deadline is met if you send the goods before the period of fourteen days has expired.

You will bear the direct cost of returning the goods.

You are only liable for any diminished value of the goods if this diminished value results from handling other than what is necessary to establish the nature, characteristics and functioning of the goods.

§ 4 Prices and shipping costs

1. All prices stated in the Ahrens online shop are total prices and include statutory value added tax at the applicable rate (for deliveries within Germany usually 19%, for goods subject to reduced tax such as feedstuffs 7%). For deliveries to other Member States of the European Union, the value added tax rate of the country of delivery may apply. In this case, the stated total price remains unchanged.

2. In addition to the stated prices, the customer will be charged the shipping costs incurred for delivery. The shipping costs and taxes will be clearly communicated to the customer again on the product pages, in the cart and on the order page and must be borne by the customer.

§ 5 Payment

1. The customer can make payment in accordance with the payment methods provided for the respective offer.

2. Payment of the purchase price is due immediately after ordering and must be received by Ahrens within 7 calendar days after Ahrens has provided the bank details.

3. Payment can be made by prepayment (bank transfer), PayPal, credit card, Klarna, Apple Pay or Google Pay. The payment methods available are shown during the order process.

4. If prepayment is selected as the payment method, Ahrens will state its bank details in the order confirmation and will deliver the goods to the customer after receipt of payment. Ahrens does not reserve the ordered goods until payment has been received. If the goods are sold out in the meantime by the time of full payment and must first be reordered, Ahrens will inform the customer of this without undue delay.

5. The customer only has a right to set-off if his or her counterclaims have been acknowledged by Ahrens or have been established by a final court decision.

6. The customer is only entitled to exercise a right of retention to the extent that his or her counterclaim is based on the same contractual relationship.

§ 6 Transfer of risk

1. If Ahrens accepts the customer’s order, the dispatch of the goods will be arranged without undue delay after receipt of the order.

2. In relation to consumers, the risk of accidental loss and accidental deterioration of the purchased item passes to the customer by law only upon delivery of the goods to the customer.

3. However, if the customer acts as a trader, the following applies: Delivery is ex warehouse. The risk of accidental loss and accidental deterioration of the goods passes to the customer at the latest upon handover to the customer. In the case of a sale by dispatch, the risk of accidental loss and accidental deterioration of the goods as well as the risk of delay passes to the customer upon delivery of the goods to the carrier, the freight forwarder or any other person or institution designated to carry out the shipment.

4. If the customer fails to carry out an act of cooperation in accepting the goods or if delivery is delayed for other reasons for which the customer is responsible, the customer is in default of acceptance. This entitles Ahrens to claim compensation for the damage incurred as a result, including additional expenses (for example storage and transport costs).

§ 7 Retention of title

Until the goods have been paid for in full, they remain the property of Ahrens.

§ 8 Warranty for material defects

1. In relation to consumers, the warranty for material defects is governed by the statutory provisions.

2. In relation to businesses, the limitation period for claims based on defects in the goods delivered by Ahrens is one year, provided that they have complied with their statutory obligations to examine the goods and give notice of defects (§§ 377, 381 HGB).

3. A guarantee in respect of goods delivered by Ahrens only exists if this has been expressly given in the order confirmation in relation to the respective item. Any manufacturer’s guarantees remain unaffected.

4. Ahrens gives no warranty for damage or defects arising from improper use, operation, storage or faulty maintenance, or from improper repair by a third party.

§ 9 Liability

1. Ahrens is liable under the statutory provisions for damage to life and health that is based on a culpable breach of duty, including by its legal representatives or vicarious agents. Furthermore, Ahrens is liable for all damage that is based on an intentional or grossly negligent breach of duty, including by its legal representatives or vicarious agents, as well as in the event of a breach of a guarantee given by Ahrens, in cases of fraud and under the Product Liability Act.

2. For damage arising from slightly negligent breaches of duty by Ahrens, its legal representatives or vicarious agents, Ahrens is only liable if an essential contractual obligation is breached that makes the performance of the contract possible in the first place and on the fulfilment of which the customer was entitled to rely. In this case, liability is limited to damage that is typically associated with the contract and foreseeable.

§ 10 Limitation

1. Claims of the consumer based on material defects become time-barred in accordance with the statutory provisions two years after delivery of the purchased item (goods).

2. By way of derogation, a limitation period of one year applies if the customer is a trader who, when concluding the contract, acts in exercise of his or her trade, business or profession.

In the event of fraudulent concealment of defects or in the event of the assumption of a guarantee as to quality, more extensive claims remain unaffected.

3. In the event of intent and gross negligence, the statutory limitation periods apply.

§ 11 Final provisions

1. Contracts between Ahrens and the customer are governed by the law of the Federal Republic of Germany, to the exclusion of the UN Convention on Contracts for the International Sale of Goods.

2. All agreements that involve an amendment, supplement or specification of these terms and conditions, as well as special assurances and arrangements, must be recorded in writing.

3. If the customer is a business, a merchant, a legal entity under public law or a special fund under public law, the place of jurisdiction for all disputes arising from the contractual relationship between the customer and Ahrens is Hamburg.

4. The possible invalidity of individual provisions of these general terms and conditions does not affect the validity of the remaining provisions.

§ 12 Customer reviews

1. In the online shop, Ahrens publishes reviews that customers submit about products. Every review is read and released by Ahrens before publication.

2. Ahrens does not check whether the person submitting the review has purchased the reviewed product from Ahrens or used it.
